Fiscal Stabilization in Oil and Gas Contracts: Evidence and Implications

Crystol Energy is pleased to highlight the publication of Fiscal Stabilization in Oil and Gas Contracts: Evidence and Implications, co-authored by Dr Carole Nakhle, CEO of Crystol Energy, and Mario Mansour, then Deputy Chief of the Tax Policy Division at the International Monetary Fund (IMF). The paper was published by the Oxford Institute for Energy Studies (OIES) as part of its internationally recognised research programme on energy economics and policy.

Fiscal stability has long been regarded as a key principle of upstream petroleum investment. However, governments regularly revise fiscal regimes in response to changing economic, political and market conditions, raising important questions about how stability can realistically be achieved while preserving governments’ ability to adapt policy over time.

Drawing on a comparative review of fiscal stabilization mechanisms across 20 petroleum-producing countries, the paper examines how stabilization clauses have evolved, the factors driving fiscal change, and the effectiveness of different contractual approaches. It concludes that traditional “freezing” clauses have generally proved ineffective in practice, while more modern approaches seek to balance investor confidence with governments’ legitimate policy objectives by focusing on economic outcomes rather than fixed fiscal rules.

The publication provides practical guidance for governments, investors and policymakers involved in designing petroleum fiscal regimes and negotiating long-term upstream contracts. It also highlights the importance of transparent, credible and adaptable fiscal frameworks in supporting sustainable investment in the oil and gas sector.
